By two writs of error the conviction of plaintiff in error Norman Weatherall (hereinafter defendant) on three counts of delivering heroin, contrary to sec. 161.41 (3) (k) and 161.41 (1) (a), Stats., is challenged. The three alleged deliveries of heroin took place on May 19, 1973, May 30, 1973, and June 15, 1973. On February 1, 1974, a criminal complaint was issued. On May 29, 1974, a preliminary hearing was held. (At the preliminary hearing and at trial the defendant was represented by retained counsel, Philip Murphy.) On May 29, 1974, the information was issued charging the three felony violations. On June 12, 1974, the jury returned a verdict of guilty on the three counts. On the same day the trial court sentenced the defendant to three consecutive terms of ten years each. Post-conviction motions were made for reduction of sentence and for a new trial, alleging ineffective assistance of counsel. The motion for a new trial was denied, but the sentences were reduced to three consecutive eight-year terms. Defendant appeals by writs of error from the Disposition of the two post-conviction motions as reflected in the amended judgment.
