Action for conversion. The facts were presented by stipulation. Defendant, Robert W. Lepper, was the president of Super Seal Company, Inc., a Wisconsin corporation. Plaintiff, engaged in
the aluminum-fabrication business, sold and delivered to Super Seal, "on open account, and without designation as to specific
jobs, certain specially ordered and constructed aluminum building materials," for a total price of $3,069.90. All but $40.85
worth of these materials "were sold for use in the improvement of the homes located in and around the city of Milwaukee, Wisconsin,
pursuant to various sales agreements made between said Super Seal Company, Inc., and its customers, which various agreements
were entered into prior to the order of the materials by Super Seal Company, Inc., from the plaintiff." The sums paid by the
customers "were used by Super Seal Company, Inc. for expenses incurred in the ordinary and normal operation of its business;
. . ." No part of these sums were paid to plaintiff for its merchandise. Defendant, as president, personally managed the above
transactions and the application of the payments. Super Seal has since been placed in receivership, but after exhaustion of
its assets $2,900 is still due to plaintiff.
